1. Scope and Provider
(1) These general terms and conditions apply to all contracts concluded by a consumer (Section 13 of the German Civil Code, BGB) via the coquet Skateboards online shop.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
(3) Deviating terms of the customer are not recognised unless the provider expressly agrees to them in writing.
(4) The provider and owner is René Körner, coquet Skateboards, Julius-Hatry-Str. 1, 68163 Mannheim, Germany.
2. Subject of the Contract
(1) The provider sells skateboards, skateboard accessories, clothing, merchandising articles and other street and board sport products via the Big Cartel shop.
(2) The essential characteristics of the products can be found in the respective product descriptions in the online shop.
(3) The goods offered are intended exclusively for end consumption. Resale for commercial purposes requires express authorisation.
3. Big Cartel as Platform Provider
(1) This online shop is operated via the Big Cartel platform. Big Cartel, LLC provides the technical infrastructure and services for the shop. The legal purchase contract is concluded exclusively between the customer and coquet Skateboards.
(2) Big Cartel collects and processes data arising from the use of the shop, including data on purchases, website display and technical purposes. Data may be transferred to the USA. Details are governed by the Big Cartel Privacy Policy
4. Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
(2) By clicking the "Pay now" or "Buy now" button, the customer submits a binding offer to conclude a purchase contract.
(3) The provider confirms receipt of the order by an automated email. This confirmation does not yet constitute acceptance of the offer.
(4) A contract is only concluded when the provider expressly declares acceptance, ships the goods or sends a shipping confirmation.
5. Prices, Shipping Costs and Product Availability
(1) All prices stated in the online shop are final prices including statutory VAT.
(2) Shipping costs are clearly stated before the order is completed.
(3) If an ordered product is not available, the provider will inform the customer without delay. Payments already made will be refunded immediately.
6. Payment Methods
(1) The customer may use the payment methods displayed in the shop (e.g. Apple Pay, Amazon Pay, credit card, PayPal, etc.).
(2) Payment processing is handled by third-party providers; their own terms and privacy policies apply to their services.
7. Delivery, Shipping and Transfer of Risk
(1) Shipping is made to the delivery address provided by the customer.
(2) The delivery time results from the information provided during the ordering process or from the provider's confirmation.
(3) If a parcel cannot be delivered (e.g. due to an incorrect address), the customer bears the resulting additional costs.
(4) The risk of accidental loss or deterioration of the goods only passes to the customer upon handover.
8. Retention of Title
The goods remain the property of coquet Skateboards until payment has been made in full.
9. Right of Withdrawal (Consumers)
(1) Consumers have the right to withdraw from this contract within 14 days without giving reasons.
(2) The withdrawal period is 14 days from the day on which the consumer or a third party named by the consumer received the goods.
(3) To exercise the right of withdrawal, the consumer must inform the provider of their decision by means of a clear declaration (e.g. an email to Email).
(4) Returns are only possible if the goods are unused and in their original packaging.
10. Returns
(1) Returns are to be sent to the following address:

(2) The customer bears the costs of the return shipment.
(3) Damaged or used goods may give rise to claims for compensation.
11. Warranty
(1) The statutory warranty rights pursuant to Sections 434 et seq. BGB apply to consumers.
(2) Obvious defects must be reported within 14 days of receipt.
(3) In the event of defects, the customer is entitled to subsequent performance (replacement delivery or repair). If subsequent performance fails, the customer may withdraw from the contract or reduce the purchase price.
12. Data Protection
(1) Personal data is collected and processed for the performance of the contract, for communication and to improve the shop.
(2) The shop is operated via Big Cartel (USA). Data may be transferred to and processed in the USA; appropriate safeguards under the GDPR (e.g. standard contractual clauses) apply.

13. Copyright
(1) All content on this website is protected by copyright.
(2) Use of this content without express written consent is prohibited.
14. Dispute Resolution
(1) The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/
(2) We do not participate in dispute resolution proceedings before a consumer arbitration board.
15. Final Provisions
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) Should any provision be invalid, the validity of the remaining provisions remains unaffected.
16. Acceptance of the Terms
By submitting the order, the customer declares that they have read, understood and accepted these terms and conditions.

The music tracks played in the audio player on this website come from the Pixabay library and are used under the Pixabay Content License. The tracks are royalty-free; attribution of the authors is not required but is given where tracks are named. The rights to the music tracks remain with the respective authors or Pixabay.
